The US intelligence community had at least four human sources inside the conspiracy and did not intervene. The US Government Problem

THE US GOVERNMENT PROBLEM
This is the elephant in the room. Five panels, three cross-examinations, and 42,000 words of analysis circle the same question: what did the US government know, and when did it know it?
What is established:
- Pretel Ortiz was an ACTIVE FBI informant who co-owned CTU Security. He was not deactivated until AFTER the assassination.
- On April 6, 2021, FBI agents met with conspirators who discussed "regime change in Haiti." The FBI claims it told them Haiti "had to solve its own political problems."
- Joseph Vincent's attorney (a former US Attorney for South Florida) stated he was "constantly in contact with the U.S. government" throughout the plot.
- Rodolphe Jaar was a former DEA informant with a documented cooperation history.
- "J.C.," an Ecuadorian lawyer in Bolivia, was a confidential informant for a REDACTED US intelligence agency and provided legal advice endorsing the capture mission.
- CIPA was invoked to classify evidence related to intelligence agency involvement.
- The FBI arrived eight days after the assassination, collected zero forensic evidence, and did not arrest known conspirators for 19 months despite interviewing them the day after.
What this means (Panel C's calibrated assessment):
- Probability of passive foreknowledge: 85-95%
- Probability of active authorization: 15-30%
- Most likely explanation: "Institutional awareness without authorized intervention" — the same pattern as the Whitey Bulger case
The April 6 meeting is the hinge. Was "Haiti had to solve its own political problems" a rejection or a coded green light? In intelligence tradecraft, a handler telling an informant "we can't help you, but we're not stopping you either" is qualitatively different from "cease this activity immediately." No panel has access to the 302 reports from that meeting. Without them, this question is unresolvable.
The CIPA question: Why invoke a statute "normally reserved for terrorism or espionage cases" in a murder prosecution? The answer determines whether the government is hiding negligence (embarrassing but not criminal) or complicity (potentially criminal). The government's opposition to deposing J.C. and its redaction of J.C.'s agency affiliation create an adverse inference: the classified evidence would likely be favorable to the defense.
The Bolivia-J.C.-CIPA triangle (Agent H's discovery): If J.C. met Intriago in Bolivia during the October 2020 coup attempt AND endorsed the Haiti operation, then a US intelligence informant provided legal cover for serial regime change operations across two countries. The CIPA classification may protect not just Haiti-related intelligence but a broader pattern of US-intelligence-adjacent privatized coups. This transforms the question from "what did the CIA know about Haiti?" to "is there a standing program that provides legal cover for privatized regime change?" The former is embarrassing. Six names cross-reference between PetroCaribe corruption and the assassination network: Martelly, Lamothe, Henry, Moïse himself, Vorbe, and Latortue. What the Prosecution Should Know
Six points. Five minutes. The case you are not making is the case that matters.
WHAT THE PROSECUTION SHOULD KNOW
If briefing the AUSA in five minutes:
1. Your case is structurally incomplete, and the defense knows it. You can convict four men for conspiracy. But the jury will ask: who ordered this? And you cannot answer. The defense will make the absent masterminds (Badio, Henry, Martelly) the stars of their closing. Every witness who says "I was told..." raises the question: told by whom? You need to get ahead of this. Acknowledge the gap. Argue it proves the conspiracy was real and large, not that these defendants are fall guys.
2. The April 6 meeting is your biggest risk. The defense will argue the FBI acquiesced. Your spin... that the conspirators tried to recruit the FBI, failed, and proceeded anyway, proving criminal intent... is clever but fragile. Agent Ferlazzo's refusal to identify all participants is a gift to the defense. Consider proactively releasing the participant list. The unknown is worse than the known.
3. Subpoena the RSR Group invoice. It is a public court record from a 2018 Florida state case. If the $15K bounced check was for the same weapon types found at the crime scene, you have a documented US weapons procurement chain. If it was for tactical gear only, you close a lead cleanly. Either way, you should already have this.
4. The Handal non-prosecution is your exposure point. Samir Handal is on US soil. His property was the staging ground. His brother controls the port where 18 assault rifles were seized. He was arrested internationally and released via Greenberg Traurig. He has not been charged. The defense and the press will both ask why. If you have a reason (insufficient evidence, ongoing investigation, cooperator), be prepared to explain it. If you do not have a reason, empanel a grand jury.
5. Flip Badio. He is in Haitian detention with no functioning justice system. Transfer to US custody for a cooperation agreement could be his only path to surviving. His testimony about the Henry phone calls, the kill order, and the financial backers would transform your case from an operational prosecution into a structural one. This is worth whatever it costs diplomatically.
6. The case you are not making is the case that matters. The CTU-to-Vectus structural parallel... same contracts, same security sector, same Bigio family bridge... is not admissible at this trial. But it is the answer to the question the jury will carry home: why was a president killed over contracts a bankrupt security firm could not afford to pursue? The answer is that CTU was the appetizer. Vectus is the entrée. And the same family connected both meals.
